Terms & Conditions of Sale
1. Definitions
"Little Haven Garden Design Ltd" ("the Company") refers to the provider of the garden design, consultancy, project management and installation services.
"The Client" refers to the person or organisation accepting the quotation.
2. Quotations
All quotations are valid for 30 days from the date of issue unless otherwise stated.
Quotations are based upon the information available at the time of the site visit and visual inspection.
Should additional work become necessary due to unforeseen ground conditions, hidden services, drainage issues or changes requested by the Client, a revised quotation or variation order will be issued for approval before additional work proceeds.
3. Acceptance of Quotation
Acceptance may be made by:
- signed quotation
- email confirmation
- written acceptance
A contract exists once acceptance has been received together with the required deposit.
4. Payment Terms
A 50% deposit is required upon acceptance of the quotation.
No design work, ordering of materials or booking of installation dates will commence until cleared funds have been received.
The remaining 50% balance shall become due:
- on the final day of installation; or
- upon handover of the completed garden design package; or
- upon practical completion of the agreed works,
whichever occurs first.
Payment shall be made by Bank Transfer (BACS) unless otherwise agreed in writing.
5. Late Payments
Invoices not settled by the due date may incur interest at 8% above the Bank of England Base Rate, together with any statutory compensation and recovery costs permitted under the Late Payment of Commercial Debts (Interest) Act 1998, where applicable.
The Company reserves the right to suspend further work until outstanding balances have been settled.
6. Design Copyright
All drawings, concepts, mood boards, visualisations, planting plans and technical designs remain the intellectual property of Little Haven Garden Design Ltd until payment has been received in full.
Designs may not be copied, reproduced or used by third parties without written permission.
7. Planning & Permissions
Unless specifically included within the quotation, the Client remains responsible for obtaining:
- Planning Permission
- Building Regulations Approval
- Party Wall Agreements
- Listed Building Consent
- Conservation Area approvals
- Utility approvals
where required.
The Company will provide reasonable assistance where requested.
8. Project Timescales
Estimated commencement and completion dates are provided in good faith.
However, they may be affected by circumstances beyond the Company's reasonable control including:
- adverse weather
- supplier delays
- material shortages
- access restrictions
- unforeseen site conditions
- Client requested changes
The Company will keep the Client informed should programme dates require revision.
9. Client Responsibilities
The Client agrees to:
- provide reasonable site access
- ensure suitable parking where available
- disclose known underground services
- advise of any restrictions affecting the property
- provide access to electricity and water where required
- remove pets from working areas
10. Variations
Any requested change to the agreed design or scope of works may affect:
- price
- programme
- materials
- completion date
All variations will be confirmed in writing before work proceeds.
11. Materials
Natural products including timber, stone, paving, plants and aggregates will naturally vary in colour, texture and appearance.
Living plants are seasonal products and their appearance will vary depending upon the time of year, weather and ongoing maintenance.
These natural variations shall not constitute defects.
12. Practical Completion
Practical Completion is achieved when the agreed works are substantially complete and capable of their intended use.
Minor adjustments, seasonal planting or agreed snagging items shall not delay final payment.
Any snagging items will be recorded and completed within a reasonable period.
13. Cancellation
Should the Client cancel after accepting the quotation:
- the initial deposit is non-refundable once design work has commenced or materials have been ordered;
- the Client shall remain responsible for all work completed up to the cancellation date;
- any bespoke materials ordered specifically for the project shall remain chargeable.
14. Photography
Unless the Client requests otherwise in writing, Little Haven Garden Design reserves the right to photograph completed projects for use within:
- website
- social media
- marketing material
- award submissions
- portfolio
Personal information and property addresses will never be disclosed without permission.
15. Guarantee
Installation workmanship is guaranteed for 12 months from Practical Completion, subject to:
- normal domestic use
- correct maintenance
- no alteration by others
The guarantee excludes:
- accidental damage
- extreme weather events
- movement caused by existing ground conditions
- plant loss due to drought, frost, pests or lack of watering
16. Complaints
Should any concern arise during the project, the Client agrees to notify Little Haven Garden Design as soon as reasonably practicable, allowing the opportunity to inspect and resolve the matter before engaging third parties.
17. Governing Law
These Terms & Conditions shall be governed by the laws of England and Wales.
18. Our Promise
